Members Present:   Mayor Ken Hamilton, James Coachman, Linda Smith, Ann Adams and Kenneth Hart  

Members Absent: Michael Capehart

Mayor Hamilton opened the meeting at 6:00 P. M.  Mayor Hamilton opened meeting with a prayer. Mayor and the Council led in the Pledge of Allegiance.

*Cottonwood Rescue used 3,557 gallons of water for the month of August.

*Discussion on Budget for Oct. 2018 – Sept 2019.

*Approval on Ordinance #2018-011 / Amending Insurance Tickets.

AN ORDINANCE TO REPEAL ANY EXISTING ORDINANCE PURTAINING TO INSURANCE TICKETS

BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF COTTONWOOD, ALABAMA THAT PROVISIONS OF THS ORDINANCE SHALL AMEND THE INSURANCE TICKET.

THIS ORDINANCE # 2018-011 SHALL OVERRIDE ANY OTHER ORDINANCE ON A TICKET FOR INSURANCE.

IF YOU RECEIVE A TICKET FOR NOT DISPLAYING INSURANCE.

AND ONLY IF YOU HAVE INSURANCE AT THE TIME OF THE TICKET.  BRING PROOF INTO THE COURT MAGISTRATE OFFICE.  IF INSURANCE IS VALUED AT THE TIME OF THE TICKET THAT WAS RECEIVED OF THE DEFENANCE. AT THE COURT MAGISTRATE DISCRETION THE FINE AND COURT COST SHALL BE DISMISSED.

Council Member Adams made a motion to except Ordinance#2018-011.  A second by Council Member Smith and the motion was approved unanimously.

 

*Approval on Resolution #2018-012 / Qualification for Reimbursement of Firefighter

Be it ordained by the Town Council of the Town of Cottonwood.  Under Reimbursements to employees that are treated as paid under an accountable plan are excluded from an employee’s gross income, are not reported as wages or other compensation on the employee’s W-2 and are exempt from the withholding and payment of employment must meet three requirements:

  1. The amounts reimbursed must have a business connection,
  2. Any amounts paid under the reimbursement arrangement which are in excess of the actual expenses incurred must be returned by the employee to the employer within a reasonable time, and
  3. The reimbursed expenses must be properly substantiated.

Rules for the Cottonwood Fire Department:

  1. MUST ATTEND 50% OF MEETINGS PER QUARTER TO BE IN REIMBURSEMENT PROGRAM.
  2. IF FIREFIGHTER CAN’T MAKE THE APPOINTED MEETINGS THEY MUST CALL AND HAVE A VALID EXCUSE. I.E.  WORK, SICKNESS OR EMERGENCY FAMILY MATTER. THESE ARE THE ONLY THINGS THAT WILL BE CONSIDERED AS A PERMISSABLE EXCUSE.
  3. ROSTER WILL BE LIMITED TO A 15 PERSON ROSTER.
  4. LIMITED ROSTER AIDS IN ISO TRAINING POINTS AND MAKES IT AFFORDABLE TO EQUIP ACTIVE FIREFIGHTERS.
  5. A LIMITED FUNDING BUDGET OF $20,000.00 PER YEAR WILL BE PROVIDED BY THE TOWN TO FUND THE REIMBURSEMENT PROGRAM.
  6. EACH RESPONDING FIREFIGHTER WILL BE REIMBURESED $20.00 PER CALL THEY RESPOND TO.
  7. REIMBURSEMENT WILL BE AWARDED EVERY QUARTER.
  8. FIRE CHIEF IS RESPONSIBLE IN PROVIDING NECESSARY DATA TO THE TOWN FOR THE REIMBURSEMENT PROGRAM.
  9. DATA WILL BE COLLECTED FROM CAD CALL IN REPORTS AS WELL AS SCENE REPORTS.
  10. THE FIRE CHIEF IS THE CONTACT FOR THE FIREFIGHTERS IF ANY QUESTIONS ABOUT THE PROGRAM OR REIMBURSEMENTS. NOT THE MAYOR, TOWN CLERK OR COUNCIL MEMBERS.
  11. THE REIMBURSEMENT PROGRAM WILL BE RENEWED EVERY YEAR AS THE BUDGET ALLOWS. AGREEMENT WILL HAVE TO BE SIGNED EVERY YEAR. THIS IS A YEAR TO YEAR PROGRAM. THE TOWN COUNCIL AND AMINISTRATION RESERVE THE RIGHT TO END THE PROGRAM AT ANYTIME IT SEES NECESSARY TO DO SO.

I, __________________, DO HEREBY, UNDERSTAND THE RULES OF THE REIMBURSEMENT PROGRAM FOR THE COTTONWOOD VOLUNTEER FIRE DEPARTMENT. WITH MY SIGNATURE AS ACKNOWLEDGEMENT I AGREE TO TERMS PRESENTED IN THIS AGREEMENT AND WISH TO BE ENROLLED IN THIS PROGRAM.

Council Member Smith made a motion to except Resolution #2018-012.  A second by Council Member Coachman and the motion was approved unanimously.

*Mayor announced that the Town of Cottonwood will be receiving the grant for Houston Street.

*Council Member Smith announced that she had talked to Ann Howard in Slocomb about grocery store

*Council Member Adams asked who has been doing all the shooting sounds around Cottonwood.  Chief Money replied it is out of the city limits.

*Leak on Joe Cook Street.

*Council Member Adams ask if it was illegal to shoot a gun in the city limits.  Mayor replied YES it is illegal see Ordinance # 05-018.

There being no further business to come before this meeting, there was a motion by Council Member Adams to adjourn the meeting. A second by Council Member Coachman and the meeting was adjourned at 6:20 P.M.

Mayor Hamilton reopened the meeting at 6:21 P. M. 

Mr. Tindall and Mr. Ward had a complaint to address to the council.  Discussion about a dog on Todd Street being aggressive. 

There being no further business to come before this meeting, there was a motion by Council Member Hart to adjourn the meeting. A second by Council Member Coachman and the meeting was adjourned at 6:40 P.M.
